Edition Collection - Terms of Sale
These Terms of Sale govern the acquisition of artwork, bespoke commissions and works from the Édition Variée directly from Jack Eagan Sculpture ("the Studio"). By placing an order and paying an initial deposit, the Client enters into a binding agreement under these terms.
1. Bespoke & Cast to Order Works: All sculptures, including limited Édition Variée (EV) releases, are individually cast to order, hand chased and chemically patinated. Under Regulation 28(1)(b) of the UK Consumer Contracts Regulations 2013 and Article 16(c) of the EU Consumer Rights Directive, works made to individual specification are exempt from statutory 14 day distance selling cooling off and cancellation rights.
2. Payment Structure
50% Production Deposit: Required upon order confirmation to secure the edition number, allocate kiln and foundry capacity, and purchase bronze and casting materials.
50% Balance: Invoiced upon completion of the artwork, alongside crating and insured shipping costs. The balance must be cleared in full prior to release or dispatch from the Studio.
3. Cancellation & Non-Refundable Deposit Policy: Because raw materials and dedicated studio time are committed immediately upon commission, the initial 50% deposit is strictly non-refundable once casting preparations or metal procurement have begun. In the rare event of cancellation by the Client prior to completion, this fee is retained to offset accrued material costs, pattern work and studio overheads.
4. Production Lead Times: Standard lead times for cast to order editions generally range between 12 and 16 weeks, unless otherwise stated on the pro-forma invoice. While the Studio adheres strictly to agreed fabrication schedules, fine art bronze casting involves meticulous technical stages (investment burnout, pouring, cold work chasing, multi stage hot patination), delivery windows are provided in good faith and may adapt to maintain absolute structural and aesthetic standards.
5. Material Character & Artistic Variation (Édition Variée): In an Édition Variée, the core architectural form is strictly limited to the stated edition size (typically 8 casts). However, each cast is hand finished, cold textured and chemically patinated individually. Subtle nuances in surface texture, mottling and patina coloration are intentional hallmarks of the hand worked bronze process as part of the deliberate aesthetic illustrated in the work of Jack Eagan Studio and do not constitute flaws.
6. Title & Ownership: Title and legal ownership of the artwork transfer to the Client only when full payment of the invoice balance, crating and shipping fees have been received and cleared.
7. Shipping, Crating & Risk
Packaging: All works dispatched outside the local studio delivery area are secured in custom built, ISPM15 compliant timber crates engineered specifically for the sculpture.
Transit & Insurance: Sculptures are dispatched via specialised fine art logistics or tracked, fully insured freight. Risk of loss or damage passes to the Client upon verified delivery.
International Duties & Taxes: For shipments outside the United Kingdom, the Client (importer of record) is responsible for all local import tariffs, customs duties and local sales taxes levied by destination authorities.
8. Receipt & Inspection: The Client must inspect the packaging upon receipt. Any exterior damage to the timber crate must be documented photographically and noted with the carrier before signing. In the event of transit damage, notify the Studio in writing within 48 hours of delivery with comprehensive photographic evidence of the crate and the artwork.
9. Copyright & Intellectual Property: The artist, Jack Eagan, retains full, exclusive copyright and intellectual property rights in all sculptures, designs, sketches and digital models worldwide. The sale of a physical sculpture transfers physical ownership only; no rights of commercial reproduction, 3D scanning, re-casting or derivative manufacturing transfer to the Client.
10. Governing Law: These terms and any contracts formed hereunder are governed by and construed in accordance with the laws of England and Wales, subject to the exclusive jurisdiction of the English courts.
